Reckless Driving vs. DUI in California: What’s the Difference?

If you've been cited or arrested in California, you may hear the terms reckless driving and DUI used interchangeably—but they're legally distinct charges. While both are serious, they come with different consequences and legal strategies. Here's what you need to know:


🚗 What Is Reckless Driving?

Under California Vehicle Code § 23103, reckless driving is defined as operating a vehicle “in willful or wanton disregard for the safety of persons or property.”
This can include:

  • Excessive speeding

  • Weaving through traffic

  • Street racing

  • Dangerous red-light running

Penalties for reckless driving may include:

  • Up to 90 days in jail

  • Fines up to $1,000

  • 2 DMV points

  • Potential license suspension

It's a misdemeanor criminal offense and can still impact your record and insurance rates.


🍺 What Is DUI?

Driving Under the Influence is prosecuted under Vehicle Code § 23152.
There are two common charges:

  • VC § 23152(a): Driving under the influence of alcohol or drugs

  • VC § 23152(b): Driving with a BAC of 0.08% or higher

First-time DUI penalties may include:

  • Fines and penalties over $2,000

  • Up to 6 months in jail

  • DUI education classes

  • License suspension

  • Ignition interlock device

  • 2 DMV points

Repeat offenses or DUIs involving injury can lead to felony charges.
